Alyssa Reed, California Energy Attorney
At Reed Energy Law, PC, we believe that effective energy law requires more than an understanding of statutes and regulations. It requires knowing how energy projects are actually developed, how land and mineral rights affect those projects, how to work with property owners and operators, and how to navigate the relationships between private companies and public agencies. Alyssa Nieto Reed has spent more than 20 years developing that combination of legal and industry experience.
Alyssa represents clients in Kern County and throughout California in matters involving energy development, real estate, land use, environmental law, mineral rights, transactions, and project development. Her experience extends across oil and gas, solar, wind, carbon sequestration, and other emerging energy projects. She has worked on projects from the earliest stages of prospect development and land acquisition through permitting, construction, operation, and long-term management.
That practical, project-focused experience is at the heart of Reed Energy Law, PC.
A Lawyer Who Understands How Energy Projects Work
Alyssa’s career has given her an unusually broad perspective on California energy development. She has worked as in-house counsel for a major California oil and gas producer, served as legal counsel within a major energy company’s business unit, and practiced at a prominent statewide business and transactional law firm.
These experiences have put her on both sides of the legal issues that arise during energy development. She has advised land, environmental, procurement, business development, planning, and other departments while also working directly on transactions, real estate matters, permitting, litigation, and regulatory compliance.
That experience matters because energy projects rarely fit neatly into a single area of law. A project may involve property rights, title questions, zoning, environmental requirements, leases, easements, government approvals, contracts, and negotiations with multiple landowners and other stakeholders. A decision in one area can have consequences throughout the project.
Alyssa approaches these issues with the larger project in mind. Rather than looking at a legal question in isolation, she works to understand what the client is trying to accomplish, what could stand in the way, and what practical options may allow the project to proceed.
Experience Across California’s Energy Industry
Alyssa has represented and advised companies involved in some of the major forms of energy development taking place in California. Her experience includes oil and gas exploration and production, utility-scale wind and solar development, concentrated solar power, photovoltaic projects, carbon sequestration, hydrogen, and other alternative energy projects. She has worked on matters involving both new project development and existing operations.
This breadth is important to the approach at Reed Energy Law, PC. California’s energy landscape includes established industries as well as newer technologies and business models. We do not approach one type of energy development as more important than another. Instead, we focus on understanding the particular project, the rights involved, the applicable regulations, and the interests of the people and companies involved.
Alyssa has been involved in projects at virtually every stage of development. Her work has included identifying potential opportunities, evaluating land and title, acquiring property and other rights, structuring transactions, obtaining entitlements, addressing environmental requirements, and helping protect existing operations.
That experience allows us to recognize potential problems early and work toward solutions before they become larger obstacles.
Bringing Land, Legal and Business Experience Together
One of Alyssa’s greatest strengths is her ability to bridge the gap between legal work and the practical realities of land and energy development. She has extensive experience analyzing title, evaluating real property and mineral interests, negotiating transactions, and working with landowners and other stakeholders. She has also managed significant land portfolios and evaluated properties for exploration, business development, carbon solutions, alternative energy projects, and other real estate opportunities.
For a project developer, understanding the land is fundamental. Before a project can be built, the parties need to know who owns the property, what rights are available, what restrictions apply, and what agreements need to be negotiated. For property owners and mineral owners, it is equally important to understand what rights they may be granting and how a proposed project could affect their property.
Alyssa brings experience from both sides of these conversations. She understands the importance of protecting a client’s legal and economic interests while also finding terms that make sense for the project as a whole. That practical approach can be especially valuable when a project involves numerous parcels, multiple ownership interests, or complicated title and access issues.
Building Relationships That Help Projects Move Forward
Legal knowledge is only one part of developing a successful energy project. The ability to communicate with the people involved can be just as important. Throughout her career, Alyssa has developed relationships with landowners, competing companies, contractors, consultants, public agencies, and other participants in California’s energy industry. She has used those relationships to negotiate transactions, bring parties together, resolve problems, and advance high-priority business objectives.
We believe this is one of the qualities that sets Reed Energy Law, PC apart.
Alyssa understands that a project can stall when the parties stop communicating or when an issue is approached only from one perspective. She works to understand the concerns of the different stakeholders and identify solutions that address the legal requirements while keeping the larger project objectives in view.
Her industry relationships have also given her firsthand knowledge of how energy projects interact with local communities and government agencies. She has worked with counties and state and federal agencies on permitting, entitlements, environmental compliance, and operational issues throughout California.
Working With California Agencies
Energy development in California often requires coordination with multiple government agencies. Alyssa has extensive experience working with state and federal agencies on project approvals, environmental requirements, permits, and operational matters.
Her experience includes matters involving the Bureau of Land Management, California Department of Fish and Wildlife, United States Fish and Wildlife Service, California Geologic Energy Management Division, California Air Resources Board, Environmental Protection Agency, and local County Boards of Supervisors.
She has worked with environmental requirements arising under laws and regulations including the California Environmental Quality Act, the Endangered Species Act, the California Endangered Species Act, the Clean Water Act, the Migratory Bird Treaty Act, and other environmental and land use requirements.
That experience allows us to approach regulatory matters with an understanding of both the legal requirements and the practical steps involved in getting a project approved and keeping an operation in compliance.
Experience With Complex Energy Litigation in California
Although our focus is on helping clients develop and protect their projects, disputes and litigation can become part of energy development. Alyssa has significant experience managing complex litigation involving oil and gas production and environmental and land use issues. She has worked with outside counsel and internal stakeholders to defend oil and gas operations in litigation where opponents sought to stop or restrict production. These matters have included significant disputes involving CEQA and the authority of local governments to regulate oil and gas operations.
Among the matters in which she has been involved was litigation challenging CalGEM’s issuance of 214 drilling permits based on allegations that the agency had failed to comply with CEQA. Alyssa also played a role in litigation concerning Monterey County’s Measure Z, a 2016 ballot initiative that sought to shut down oil and gas production in the county. The litigation ultimately resulted in a California Supreme Court decision invalidating Measure Z on state preemption grounds.
These experiences have reinforced an important part of Alyssa’s approach: anticipating legal challenges early can be just as important as responding effectively when a dispute reaches court.
From the Oil and Gas Industry to Emerging Energy Technologies
Alyssa’s background includes substantial experience in California’s oil and gas industry, but her practice has never been limited to one form of energy. She has worked on the development and entitlement of renewable energy projects and emerging technologies, including large-scale wind and solar developments, concentrated solar power, carbon sequestration, hydrogen, and other alternative energy projects.
Her work has included evaluating zoning and general land use restrictions, determining potential entitlement pathways, identifying and acquiring property interests, and working through the regulatory requirements associated with new projects. That combination of experience is particularly relevant as California’s energy industry continues to evolve. New technologies can create new opportunities, but they can also raise unfamiliar questions involving land use, property rights, environmental regulation, infrastructure, and long-term operations.
We help clients address those questions while keeping the practical objectives of the project in focus.
A Foundation in Environmental and Land Use Law
Alyssa’s interest in energy and environmental issues started even before her legal career began. She earned her undergraduate degree in Environmental Studies from the University of California, Santa Barbara, where her education focused on energy sources and consumption, environmental regulation, and the processes governing land use and development. She later earned her Juris Doctor from Santa Clara University School of Law, where her studies included state and federal environmental law, land use planning and development, and transactional law.
Her educational background and professional experience complement one another. Alyssa understands the environmental and regulatory considerations that can affect a project, while also understanding the property, contractual, and business issues that determine how a project can actually be developed. She also maintains connections within the local energy and legal communities through her active involvement with the Kern County Bar Association and the Bakersfield Association of Petroleum Landmen.
A Practical Approach to Energy Law
After more than two decades working in the energy industry, Alyssa understands that clients generally do not need legal advice in the abstract. They need to know what a legal issue means for their project and what they can do about it. Our approach is therefore practical and collaborative. We take the time to understand the property, the project, the parties involved, and the client’s objectives. We then work to identify legal risks, evaluate options, negotiate where appropriate, and develop solutions that can work in the real world.
Whether we are helping an operator address a property dispute, assisting a company with a new energy development, negotiating an agreement with a landowner, analyzing mineral rights, or navigating land use and environmental requirements, we bring the same project-focused perspective to the matter. Alyssa’s experience working inside energy companies is particularly valuable in this respect. She has seen firsthand the pressures involved in managing land portfolios, meeting development schedules, addressing regulatory requirements, and balancing legal considerations with business objectives. She understands that legal counsel should help solve problems rather than simply identify them.
